Articles 2 to 5 of the Convention. Implementing legislation. The Committee notes the Government’s response that there has been no change since the previous reports. The Committee understands that Executive Council paper No. 202/09 sets out the terms of reference for a policy review to fully assess the existing employment practices and legislation within the Falkland Islands, and to advise the Legislative Assembly on the need to update the Employment Protection Ordinance of 1989. The terms of reference for the review focused on what was suggested as being the key areas of employment legislation, including leave and working hours (covering flexitime, maternity and paternity leave, sick leave, etc.), and a final report was expected by March 2011. The Committee understands that the process of revision of the Employment Protection Ordinance is still ongoing. The Committee therefore requests the Government to provide additional information on the current status of the review process – especially as regards any aspect that might have an impact on the application of the Convention – and to transmit copies of any new text once it has been adopted.
