The Committee last examined this case, relating to anti-union dismissals and transfers and withdrawal of the check-off facility in the health sector, at its June 2001 meeting [see 325th Report, paras. 489-509]. On that occasion, the Committee requested the Government to ensure that the transferred officers are not impeded in the exercise of their trade union activities, and to re-establish the payroll check-off facility.

In a communication dated 20 July 2001, the Government refers to the communication of the Ministry of Labour dated 16 April 2001, already examined by the Committee at its June 2001 meeting, in which it points out that the deduction of union dues is carried out once the express consent of each worker has been obtained and that a list of such deductions must be submitted to the employer; should the employer refuse to authorize them, the trade union has the right to ask the departmental offices of the Ministry of Labour to take the necessary measures to guarantee compliance with labour legislation.
- 114. The Committee regrets that the Government has not provided any new information and urges the Government immediately to adopt appropriate measures to guarantee the exercise of trade union activities by the transferred officers and to proceed to re-establish the payroll check-off facility.
