Effect given to the recommendations of the committee and the Governing Body- 42. The Committee last examined this case at its October 2020 meeting and on that occasion reiterated the firm expectation that the Government will take all the necessary steps to ensure compliance in the very near future with the 2015 ruling of the Supreme Court of Justice and to ensure that the general secretary of the Callao Regional Government Workers’ Union, Ms Clara Tica, can be reinstated in a post similar to the one from which she was dismissed in 2011 as a result of her trade union activity related to the collective dismissal of workers. The Committee requested the Government to keep it informed in this respect [see 392nd Report, October 2020, para. 129].

In its communication dated 14 January 2021, the Government states that, on 25 July 2019, Ms Clara Tica was reinstated in the position of telephone switchboard operator in the Information Technology Office of the Regional General Management of the regional government of Callao, in fulfilment of the court decisions handed down in Ms Tica’s favour. The Government also indicates that the reinstatement in that position was accepted by the worker and requests the Committee, if it deems it appropriate to do so, to declare the present case definitively closed. The Committee notes this information with satisfaction. The Committee therefore considers this case closed and will not pursue its examination.
