The Committee last examined this case at its June 2013 meeting, when it asked the Government to inform it of the outcome of the cassation appeal filed by the trade unionist, Mr William Alburquerque Zevallos, relating to his dismissal from the enterprise CrediScotia Financiera SA (the appeals court had upheld the first instance ruling that had ruled against him) [see 368th Report, para. 85].

In its communication dated 16 January 2014, the Government states that, in a ruling dated 9 October 2013, the Standing Chamber of Constitutional and Social Law of the Supreme Court of Justice of the Republic upheld the cassation appeal, thus declaring the first instance ruling null and void and finding the appealed ruling of 31 January 2012 without merit. The Government adds that, on 27 December 2013, the decisions were returned to the originating court.
  3. 88. The Committee takes note of this information. The Committee finds the excessive delay in the judicial proceedings regrettable and requests the Government to keep it informed of any ruling handed down by the originating court relating to the dismissal of the trade unionist, Mr William Alburquerque Zevallos, from the enterprise CrediScotia Financiera SA.
