The Committee notes that the Government’s report has not been received. It hopes that the next report will contain full information on the matters raised in its previous comments.

Article 5(1) of the Convention. Effective tripartite consultations. In reply to the Committee’s previous comments, the Government indicates that copies of the reports and questionnaires to be submitted to the ILO are sent to the most representative employers’ and workers’ organizations in order to obtain their comments. It adds that all comments received from the social partners are then included in the Government’s reports. The Government also indicates that discussions concerning the possibility of ratifying the Labour Clauses (Public Contracts) Convention, 1949 (No. 94), were held in the tripartite Economic and Social Council (ESC) on 10 April 2015 and 7 January 2016. The Government indicates that consensus had not yet been reached among the competent ministries regarding the possible ratification of the Convention. Therefore, the ESC adopted a decision that the competent ministries would submit their individual views on the matter, which would then be sent to the social partners for their comments. Moreover, the Committee notes the adoption of the Rules of Procedure of the Economic and Social Council on 23 December 2016 which, among other things, defines the key economic and social areas that make up the ESC’s field of work, and introduced ESC Expert Committees and Negotiating Teams, including the Expert Committee on Labour and Social Affairs. The Committee notes the Government’s indication that section 3 of the Rules of Procedure provides that key ILO documents are one of the main economic and social areas with which the ESC is concerned.The Committee requests the Government to continue to provide detailed information on the content and outcome of the consultations held in the Economic and Social Council on all matters concerning international labour standards covered by Article 5(1) of the Convention, in particular, on the re-examination of unratified Conventions and of Recommendations to which effect has not yet been given (Article 5(1)(c)).

Article 5 of the Convention. Effective tripartite consultations. The Committee notes the Government’s first report on the application of the Convention received in November 2013 as well as the additional information received in August 2014. The Committee notes that the Economic and Social Council (ESC) was established in order to consider measures concerning economic and social policies, and issues related to the specific fields of the partners’ dialogue; it meets on the initiative of one of the social partners or at least once a month. The Government indicates that reports, questionnaires and other materials are presented to the ESC for discussion, prior to their submission to the ILO. The ESC also discusses initiatives for new ratifications. The Committee also notes that a permanent tripartite working party was established in January 2012, following a decision by the ESC, for cooperation with the activities of the ILO as well as other international organizations in the area of labour and social affairs. The Committee invites the Government to provide detailed information on the content and outcome of the consultations held on the matters concerning international labour standards covered by Article 5(1) of the Convention.
