Replies received to the issues raised in a direct request which do not give rise to further comments (CEACR) - adopted 2022, published 111st ILC session (2023)

The Committee notes the information provided by the Government, which answers the points raised in its previous direct request and has no further matters to raise in this regard.

Direct Request (CEACR) - adopted 2012, published 102nd ILC session (2013)

Article 6(1) of the Convention. Physical and vocational rehabilitation of children and young persons found to be unsuited or to have physical handicaps or limitations. The Committee had previously requested the Government to indicate the measures adopted for the education and vocational guidance and rehabilitation of children and young persons who are not deemed suited to employment as a result of the medical examination.
The Committee notes that, pursuant to section 296 of the Labour Code No. 106 of 2004 as amended, a mandatory medical examination prior to the conclusion of an employment contract and regular annual examination shall be required of persons who are below the age of 18 years. It notes with interest that as per sections 317–319 of the Labour Code the employer shall ensure additional guarantees of employment, including creating new jobs and conditions of work, specialized enterprises, individual rehabilitation programmes or special training programmes for disabled persons, as well as workers whose disablement has resulted from an accident at the workplace or from an occupational disease. The Committee also notes that Law No. 421–XII of 1991 on Social Protection of the Disabled provides for the medical, vocational and social rehabilitation of disabled persons, as well as their development, education and vocational guidance and integration into the workforce.
