In regard to Articles 2, 3, 4, 5, 6 and 7(1) of the Convention, the Committee requests the Government to refer to the comments it has made in relation to Convention No. 77.
Article 7(2)(a). Supervision of the application of the system of medical examination for fitness for employment to children and young persons engaged either on their own account or on account of their parents. Referring to its previous comments, in which it noted that there is no provision for measures of identification for ensuring the application of this system of medical examination of fitness for employment to children and young persons engaged either on their own account or on account of their parents in itinerant trading or in any other occupation carried on in the streets or in places to which the public have access, the Committee notes with interest that pursuant to section 3, paragraph 12, of Decree Law No. 174 of 1997 on personal contraventions of the labour regulations for a person’s own account, it is prohibited to employ a child of less than 18 years of age for an occupation on his own account.
Article 7, paragraph 2(a), of the Convention. The Committee notes that there is no provision requiring the identification of young persons engaged either on their own account or on account of their parents in itinerant trading or in any other occupation carried on in the streets or in places to which the public have access. The Committee requests the Government, if there is no provision in law or regulations which provides for the identification of young persons engaged in the above activities, to take the necessary measures to give effect to this provision of the Convention.
The Committee requests the Government to refer to its comments under Convention No. 77 in relation to Articles 2, 3, 4, 5, 6 and 7.
