Labour Statistics Convention, 1985 (No. 160) - Kyrgyzstan (Ratification: 1992)

The Committee welcomes the Government’s response to its previous comments initially made in 2016. The Committee therefore once again requests that the Government supply copies of the legislative texts giving effect to the Convention. It also reiterates its request that the Government take measures to give full effect to Article 3 of the Convention and to indicate, for each Article of the Convention in respect of which the Government has accepted the obligations, the manner in which representative organizations of employers and workers are consulted.
Article 8 of the Convention. Statistics of the structure and distribution of the economically active population. The Committee notes that the Government continues to supply data on employment, unemployment and underemployment to the ILO Department of Statistics for dissemination through its website (ILOSTAT). The Government indicates that the annual publication of Employment and Unemployment is produced using the findings of the integrated survey of household budgets and the labour force. The latest data available in ILOSTAT is from 2018. The Committee notes with interest the Government’s indication that, in accordance with the Resolution concerning statistics of work, employment and labour underutilization (Resolution I) adopted by the 19th International Conference of Labour Statisticians (October 2013), the National Statistics Committee has added the following sections to the Employment and Unemployment survey: “Production of goods in households” (four questions); “Construction and repair of own housing and buildings” (three questions); and “Provision of services to others for pay” (four questions). The Government adds that data on the new indicators will be compiled based on the findings of the 2019 labour force survey. The Committee requests that the Government continue to supply updated data and information on the methodology used in the application of this Article of the Convention. It also invites the Government to provide updated information on any further developments in relation to the implementation of the Resolution concerning statistics of work, employment and labour underutilization (resolution I), adopted by the 19th International Conference of Labour Statisticians (October 2013).
Article 9(2). Statistics on time rates of wages and normal hours of work. The Government reiterates its indication in previous reports that wage data are published monthly in the Socio-economic situation in Kyrgyzstan and a statistical bulletin entitled Findings from annual reports on the number and wages of workers. Wage data are published annually. The Committee notes that statistics of average monthly earnings and average weekly hours actually worked are provided by the Government and published in ILOSTAT, but that statistics on wage rates and normal hours of work are not available.   The Committee therefore reiterates its request that the Government indicate whether statistics on wage rates and normal hours of work continue to be produced and, if so, to communicate the published statistics without delay. It further requests the Government to continue to provide updated information in relation to the application of Article 9(2).
Article 16. Acceptance of obligations. Referring to its previous comments, the Committee once again draws the Government’s attention to the possibility of accepting the obligations under Articles 11–15, in accordance with Article 16(3). The Committee reiterates its request that the Government provide information in this regard. It further requests the Government to continue to provide information and statistics referred to under Articles 11–15 of the Convention and any relevant methodological information available.

The Committee once again requests the Government to take measures to give full effect to this provision and to indicate, for each Article of Part IV of the Convention in respect of which the Government has accepted the obligations, the way in which representative organizations of employers and workers have been consulted.
Article 8. Statistics on the structure and distribution of the economically active population. The Committee notes that the second national population census was conducted in 2009 and its results are available on the website of the National Statistics Office. The Committee invites the Government to include, in accordance with Articles 5 and 6 of the Convention, information on all relevant sources used in collecting and compiling statistics on the economically active population and communicate the published statistics to the ILO.

Direct Request (CEACR) - adopted 2013, published 103rd ILC session (2014)

The Committee notes the Government’s report received in October 2012 in which it indicates that the National Statistics Committee is the main organization responsible for the compilation of statistics covered by the Convention. According to the Government’s report, statistics are based on ILO standards and guidelines. The Committee notes that statistics of the economically active population, employment and unemployment are collected and compiled through the integrated sample survey of household budgets and the labour force and conducted on a quarterly basis, covering the population as a whole (Article 7 of the Convention). Moreover, the Committee notes that the Government regularly provides replies to the questionnaire for the ILO Yearbook of Labour Statistics. It notes, however, that the Government has still not supplied the legislative texts giving effect to the Convention. The Committee therefore once again requests the Government to supply copies of the legislative texts giving effect to the Convention.

The Committee notes with regret that the Government’s report has not been received. It hopes that a report will be supplied for examination by the Committee at its next session and that it will contain full information on the matters raised in its previous direct request, which read as follows:

The Committee takes note of the Government’s report after a period of seven consecutive years in which it failed to meet its obligation under article 22, following the transmission of a first report in 1998, i.e. several years after the ratification of this instrument. While noting the delay in this initiative, it welcomes the resumption of dialogue with the Government and requests it to supply further information on the following points.
Legislation. Noting that, despite repeated requests, the Government has still not supplied the legislative texts giving effect to the Convention, the Committee once again requests it to do so as soon as possible.
Article 3 of the Convention. The Committee reminds the Government of the obligation laid down by this Article to consult representative employers’ and workers’ organizations when designing the concepts, definitions and methodology for the collection, compilation and publication of the required statistics. The Committee requests the Government to take measures to give full effect to this provision and to indicate, for each Article of Part IV of the Convention in respect of which the Government has accepted the obligations, the way in which representative organizations of employers and workers have been consulted.
Article 7. While noting that this Article is applied, the Committee requests the Government once again to indicate whether it follows the ILO ISCO-88 classification and/or the ICSE-93 international classification. It reminds the Government of its obligation under Article 6 to communicate information to the Office on the methodology used.

The Committee requests the Government to indicate whether measures are contemplated for expanding the compilation of current statistics on hours of work by disaggregating them by sex (Articles 9 and 10). The Committee would be grateful if the Government would supply a detailed description of the sources, concepts and methodology used for the compilation of statistics under Articles 10 and 11 and also the definition of the concept used with regard to “labour cost”.
Finally, the Committee encourages the Government to continue supplying the statistics referred to in Articles 9 and 11 as soon as available and practicable.
Article 16. The Committee strongly encourages the Government to continue supplying information to the Office concerning the statistics relating to the subjects covered by Articles 11 and 12, together with any available methodological information.
Article 13. The Committee would be grateful if the Government would send the Office the results of the household income and expenditure survey and also any available relevant methodological information.
Part V of the report form. The Committee requests the Government to indicate the representative organizations of employers and workers to which copies of the present report have been communicated in accordance with article 23, paragraph 2, of the ILO Constitution. If copies of the report have not been sent to such organizations, or if they have been sent to other organizations, the Government is requested to supply information on any particular circumstances existing in the country which explain the procedure followed.
Please also indicate whether employers’ or workers’ organizations have issued any observations, either of a general kind or in connection with the Government’s next report, regarding the practical application of the provisions of the Convention or the application of the legislation or other measures implementing the Convention. If so, please send a copy of the observations received, together with any comments that the Government considers useful.

Observation (CEACR) - adopted 2006, published 96th ILC session (2007)

The Committee notes with regret for the seventh year in succession that the Government’s report has not been received. It hopes that a report will be supplied for examination by the Committee at its next session and that it will contain full information on the matters raised in its previous direct request, reiterated since 1999, which read as follows:

Legislation. As the only mention of legislation in the report is the reference to Law No. 1391-XII “On State Statistics” in connection with confidentiality, the Committee requests the Government to provide a list of the laws and regulations which apply the provisions of the Convention.

Article 2 of the Convention. The Committee asks the Government to indicate which of the international standards were taken into account when designing the concepts and methodology for the collection and publication of the statistics covered by Articles 8 to 10 of the Convention. It notes that the National Statistical Committee is engaged in a reform of the official statistics, in line with the international guidelines, and asks the Government to keep the ILO informed of the developments and the implementation of this reform.

Article 3. As there is no information about consultation with representative organizations of employers and workers the Committee requests the Government to indicate if these organizations have been or are consulted when developing and/or improving the statistical infrastructure and when revising concepts and methodology, as well as at which stage of the statistical and technical process the consultations took (take) place with regard to the statistics covered by the Convention.

Article 7. Although employment data are classified according to the United Nations classification, ISIC-Rev. 3, the Committee asks the Government to indicate whether it follows the ILO International Standard Occupational Classification (ISCO-88) and/or the International Classification of Status in Employment (ICSE-1993) (in accordance with Article 2).

Noting that no methodological information has been made available to the ILO, the Committee draws the attention of the Government to the obligations under Article 6 to communicate such information to the Office.

Article 8. As no information is available at the Office on the next population census, if one is planned, the Committee asks the Government to indicate whether, and if so when, such a census is foreseen.

Articles 9 and 10. The Committee notes that these Articles are substantially applied. It however requests the Government: (i) to publish the relevant statistics and to communicate to the ILO, as soon as practicable, the published statistics and, in particular, the titles and reference numbers of printed publications or the equivalent descriptions or reports in the case of data disseminated in other forms (in accordance with Article 5); (ii) to communicate to the ILO the most recent dates and periods for which the different types of statistics are available (also in accordance with Article 5); and (iii) to produce and communicate to the ILO detailed descriptions of the sources, concepts, definitions and methodology used in collecting and compiling the statistics (in accordance with Article 6).

Article 16. The Committee notes the information in respect of Articles 11 to 15, obligations under which have not been accepted. It is for the purpose of clarifying the extent to which effect is already given to them that the Committee is making the following remarks on some of these Articles.

Article 11. The Committee notes that statistics of average labour cost seem to have been compiled since 1994, providing data on the level and structure of labour cost. However, the breakdown by economic activity does not appear to be available. No methodological information is available either. The Committee encourages the Government to send to the ILO information concerning the publication of these statistics together with any available methodological information.

Article 12. The Committee encourages the Government to supply regularly all items and food groups monthly indices to the ILO and to provide the ILO with the relevant publications. It asks the Government to keep the ILO informed of any future developments in the field of CPI.

Article 13. The Committee encourages the Government to communicate to the ILO the results of the annual household income and expenditure survey together with a detailed description of the sources, concepts, definition and methodology used in collecting and compiling household income and expenditure statistics, if available.

It also requests the Government to keep the ILO informed of any future developments in the field of household income and expenditure statistics as there are some indications that the survey will be extended.

Article 14. The Committee encourages the Government to communicate to the ILO the relevant publications and reports concerning statistics of occupational injuries and occupational diseases.

Article 15. In accordance with Article 16, paragraph 4, the Committee would be grateful if the Government would indicate the law and practice on the statistics covered by Article 15 (statistics of strikes and lockouts) and any development concerning the extent to which effect is given to it, and to supply any available statistics and the relevant methodological information.

Article 12. The Committee encourages the Government to supply regularly all items and food groups monthly indices to the ILO and to provide the ILO with the relevant publications. It asks the Government to keep the ILO informed of any future developments in the field of CPI.

Article 13. The Committee encourages the Government to communicate to the ILO the results of the annual household income and expenditure survey together with a detailed description of the sources, concepts, definition and methodology used in collecting and compiling household income and expenditure statistics, if available.

It also requests the Government to keep the ILO informed of any future developments in the field of household income and expenditure statistics as there are some indications that the survey will be extended.

Article 14. The Committee encourages the Government to communicate to the ILO the relevant publications and reports concerning statistics of occupational injuries and occupational diseases.

Article 15. In accordance with Article 16, paragraph 4, the Committee would be grateful if the Government would indicate the law and practice on the statistics covered by Article 15 (statistics of strikes and lockouts) and any development concerning the extent to which effect is given to it, and to supply any available statistics and the relevant methodological information.
