The Committee last examined this case, which concerns allegations of violations of ILO Conventions in the setting up, composition, and appointment of members of the National Wages/Pay Council (NPC), at its March 2011 meeting. On that occasion, the Committee requested the Government to provide, as it had indicated its intention to do, detailed information on the establishment and functioning of the commission dealing with the question of annual pay within the National Tripartite Forum. The Committee expected that the Trade Union Common Platform (TUCP) would be fully consulted in this process [see 359th Report, paras 96–98].

In its communication dated 14 October 2011, the Government states that the quantum of the salary compensation for year 2011 was determined at the level of a subcommittee of the National Tripartite Forum which was set up on 25 October 2010, following various meetings held with both workers’ and employers’ organizations. At one of the meetings chaired by the Deputy Prime Minister and Minister of Finance and Economic Development on 18 November 2010, it was decided that for 2011 the inflation rate be the only criterion used to determine the quantum of the annual salary compensation. Despite the fact that the inflation rate was only 2.7 per cent in 2010, the Government made a special effort to compensate workers at the lowest rungs of the ladder by giving them a 3.2 per cent increase. In addition, the minimum salary on which full compensation was payable, was raised from 4,000 Mauritian Rupees (MUR) to MUR5,000. To give effect to this decision, the Additional Remuneration (2011) Act 2010, Act. No. 11 of 2010 was passed by the National Assembly on 14 December 2010.

186. The Committee welcomes this information. Noting, however, that the Government did not provide information on the establishment, composition, appointment and functioning of the commission dealing with the question of annual pay within the National Tripartite Forum, it requests the Government to provide this information. The Committee further requests the Government to ensure that consultations take place within this framework with the TUCP.
