Repetition Article 4 of the Convention. Standards for certificates of competency. The Committee notes the Government’s indication in its report that there are around 600 artisanal fishers in the country, organized in five cooperatives. The Government adds that fishers in Djibouti do not currently have a competency certificate and that the country does not have legislation giving effect to the Convention. The Committee requests the Government to provide information on any measures adopted or envisaged to give effect to the Convention.
The Committee notes the Government’s indication that the situation has not changed since its last report. It recalls, in this regard, the Government’s statement in earlier reports that the fishing sector is practically non-existent in the country. The Committee once again observes that, in light of the absence of a fishing industry, the Convention is in essence without object and therefore regular reporting on its application serves little purpose. The Committee accordingly requests the Government to keep the Office informed of any possible future developments that might significantly affect the application of the Convention in either law or practice.

Given the circumstances, the Committee considers it unnecessary to comment at this point on the application of the Convention in either law or practice.

The Committee notes the information in the Government’s report indicating the adoption of the Maritime Code and implementing texts, in particular Order No. 85-040/PR/PM setting the requirements for the skipper and the crew. It further notes that Order No. 85-0044/PR/PM creates a maritime committee to validate certificates. The Committee takes note from the Government’s report that at present Djibouti has only one vessel and it is engaged in cabotage.

Further to its previous comments, the Committee notes that the draft texts to apply the Maritime Code are still under study. It hopes that measures will be taken on this matter which has been the subject of its comments for several years and that the Government will be in a position to supply information on any new development in this respect in the very near future. It also reiterates its request to the Government to indicate if there are fishing vessels of 25 gross registered tons or more, whether publicly or privately owned, registered in Djibouti, and engaged in maritime fishing in salt waters (Article 1 of the Convention).
