Repetition The Committee notes with deep concern that the Government’s report, due since 2016, has not been received. In light of its urgent appeal launched to the Government in 2019, the Committee proceeds with the examination of the application of the Convention on the basis of the information at its disposal. Application of the Convention in practice. In its previous comments, the Committee noted that Saint Lucia had concluded reciprocity agreements on social security with the Caribbean Community (CARICOM) countries, the countries of the Organisation of Eastern Caribbean States (OECS), and Canada and requested the Government to provide information on the application of the Convention in practice. The Committee observes that, under section 91 of the National Insurance Regulations of 2003, the payment of social security benefits, including compensation in case of work accidents, may be arranged if a beneficiary permanently resides in another country with which Saint Lucia has not concluded a reciprocal agreement. The Committee requests the Government to provide information on the institutional arrangements put in place to ensure the provision of compensation to beneficiaries residing in a country with which there are no reciprocal agreements, and on the form that such arrangements take. The Committee further requests the Government to provide information on the application of the Convention in practice, including statistical data on the number and nationality of foreign workers employed in Saint Lucia as well as the amount of compensation in case of work accidents paid to persons residing abroad and the country of destination.
Repetition Application of the Convention in practice. The Government’s report, received in August 2012, indicates that it will soon resubmit copies of Acts Nos 5, 12, 13 and 14 of 2001 transposing into national legislation special agreements concluded with the CARICOM countries, countries of the OECS and Canada, in order to facilitate reciprocity. Please provide, as required by Part V of the report form, information, including statistics, on the manner in which effect is given to the Convention in practice, specifying, for instance, the number and nationality of foreign workers employed in Saint Lucia as well as the amount of accident compensation benefits paid to persons residing abroad, indicating the country of destination.
With reference to its previous comments, the Committee notes the statistical information provided by the Government in its report as regards the number of foreign workers employed in Saint Lucia. It notes, however, that the report does not supply copies of Acts Nos 5, 12, 13 and 14 of 2001 promulgating special agreements concluded with CARICOM and OECD countries, as well as with Canada in order to facilitate reciprocity were transposed into national legislation. The Committee therefore invites the Government to provide the above copies with its next report and to continue to supply with future reports statistical information on the manner in which national, as well as foreign workers and their dependants, benefit from compensation in case of occupational accidents.
